End User License Agreement

1. License Grant

PARAINOIA grants you a non‑exclusive, non‑transferable, revocable license to use the Service for personal, non‑commercial purposes, subject to this Agreement. The Service includes the PARAINOIA client application, VPN connectivity, and access to encrypted communication features, accessible via https://parainoia.com.

2. Privacy & Zero‑Logging Policy

PARAINOIA is committed to your privacy. The Service operates on a strict zero‑logging policy:

  • No personal information, including email addresses, is required to create an account.
  • No data, including WireGuard public keys or VPN session details, is logged or stored.
  • Accounts are identified solely by a randomly generated 16‑digit number, ensuring no traceability to an active VPN session.

Your use of the Service is designed to maximize anonymity and security, with all communications protected by TLS 1.3 and AES‑256 encryption.

3. Permitted Use

You agree to use the Service in compliance with applicable laws and this Agreement. You may:

  • Create an anonymous account and add credits to access the VPN.
  • Use the client application to generate keys, connect to the VPN, and engage in encrypted messaging or streaming.
  • Access VPN‑exclusive features, such as encrypted communications, only through the VPN tunnel.

4. Prohibited Use

You may not:

  • Use the Service for illegal activities, including but not limited to hacking, fraud, or distribution of malicious software.
  • Attempt to reverse‑engineer, decompile, or modify the client application or Service.
  • Share, transfer, or resell your account or access credentials.
  • Use the Service to bypass restrictions or access unauthorized systems.

PARAINOIA is not responsible for any actions you take while using the Service, including any misuse or illegal activities. You are solely accountable for ensuring your use complies with all applicable laws and regulations. Violation of these terms may result in immediate termination of your access without refund.

5. No Warranty

The Service is provided “as is” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or non‑infringement. PARAINOIA does not guarantee uninterrupted or error‑free operation of the Service. You use the Service at your own risk.

6. Limitation of Liability

To the maximum extent permitted by law, PARAINOIA shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to data loss, security breaches, or service interruptions. You are solely responsible for securing your devices and data.

7. Termination

PARAINOIA may suspend or terminate your access to the Service at any time, with or without cause, including for violation of this Agreement. Upon termination, your license to use the Service ends, and you must cease all use.

8. Intellectual Property

The Service, including the client application, is protected by copyright and other intellectual property laws. All rights not expressly granted in this Agreement are reserved by PARAINOIA.

9. Governing Law

This Agreement is governed by the laws of Switzerland, reflecting our commitment to data residency in a privacy‑respecting jurisdiction. Any disputes shall be resolved in the courts of Switzerland.

9a. Dispute Resolution

Before initiating any legal action, both parties agree to attempt to resolve disputes amicably through good‑faith negotiations. If resolution cannot be achieved within 30 days, disputes shall be submitted to confidential binding arbitration under the rules of the Swiss Chambers’ Arbitration Institution. The arbitration shall take place in Switzerland, and the decision shall be final and binding.

9b. Force Majeure

PARAINOIA shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, labor disputes, governmental actions, utility or telecommunications failures, or network outages.

9c. Severability

If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.

10. Changes to the Agreement

PARAINOIA may update this Agreement at any time. Changes will be posted at https://parainoia.com, and your continued use of the Service constitutes acceptance of the updated terms.
